2. Description of Canadian Wedding Photographers Services

Canadian Wedding Photographers is a photography directory of wedding photographers who operate in Canada. 

Canadian Wedding Photographers is only a directory service to help pair couples with wedding photographers. Each photographer is an independent business and therefore responsible for their services. It is recommended that you contact the photographer directly and perform due diligence prior to hiring. Canadian Wedding Photographers makes no guarantees of their performance, and is not responsible for their services. 

3. Changes to Terms

Canadian Wedding Photographers reserves the right to modify these terms at any time, with changes becoming effective immediately upon posting. It is your responsibility to review the terms regularly for updates.

4. User Conduct

Do not disrupt or interfere with Canadian Wedding Photographers' services, including hacking, distributing malware, or violating applicable laws.

5. Intellectual Property

All content, trademarks, logos, and intellectual property on this website belong to Canadian Wedding Photographers and are protected by copyright laws. Reproduction or use of any content requires explicit permission.

6. Notice and Procedure for Making Claims of Copyright or Intellectual Property Infringement

Canadian Wedding Photographers respects the intellectual property of others, and we ask our users to do the same. Canadian Wedding Photographers may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers. c. a description of where the material that you claim is infringing is located on the site; 

d. your address, telephone number, and email address; 

e. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; 

f. a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

 7. User-Submitted Content

Canadian Wedding Photographers may provide users with the opportunity to submit content, including but not limited to images, reviews, and comments. By submitting content to Canadian Wedding Photographers, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content in any form, medium, or technology now known or later developed.

You acknowledge that Canadian Wedding Photographers may use user-submitted content for promotional, marketing, or other business-related purposes, both online and offline. However, we will make reasonable efforts to attribute authorship to such content where appropriate.

You represent and warrant that you have the necessary rights, permissions, and authority to grant the aforementioned license to Canadian Wedding Photographers. You further agree that your submitted content will not violate any third-party rights, including copyright, trademark, privacy, or publicity rights.

Canadian Wedding Photographers reserves the right to review, monitor, and remove any user-submitted content that violates these terms or is deemed inappropriate at our sole discretion.

8. Acceptance of User Agreement

By submitting content to Canadian Wedding Photographers, you acknowledge and agree to the terms outlined in the "User-Submitted Content" section. Failure to comply with these terms may result in the removal of your content and, in some cases, the termination of your account.

9. Limitation of Liability

Canadian Wedding Photographers, its owners, affiliates, employees, and agents shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  • The use or inability to use our Site;
  • Unauthorized access to or use of our servers and/or any personal information stored therein;
  • Any interruption or cessation of transmission to or from our Site;
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party;
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.

These limitations shall apply to the fullest extent permitted by law, and in no event shall Canadian Wedding Photographers' total liability to you exceed the amount paid by you, if any, for accessing our Site.

13. Payment and Refund Policies

Membership Fees
Canadian Wedding Photographers offers a membership program that provides users with exclusive benefits for a period of one year. Upon acceptance of your membership application and completion of the payment process, your membership will be activated. The membership fee is non-refundable and ensures access to the benefits of membership for one year, starting from the date the payment is successfully processed.

Payment Terms
Payment for membership must be made in accordance with the pricing and payment terms provided on the Canadian Wedding Photographers website. Users are responsible for ensuring the accuracy of their payment information and maintaining up-to-date payment details to avoid any interruption in membership benefits.

Renewal
Memberships are set to automatically renew for another year unless canceled by the user before the renewal date. Renewal fees will be processed using the payment information on file unless updated by the user.

Cancellation
Users may cancel their membership at any time, but no refunds will be provided for the remaining period of the membership term.

Changes to Membership Fees
Canadian Wedding Photographers reserves the right to modify membership fees at any time. Any changes to fees will be communicated to users in advance, and users will have the option to accept the new fees or cancel their membership before the renewal date.

Refunds
In the event of a technical error resulting in an overcharge, users are entitled to a refund of the overcharged amount. Refund requests must be submitted to hello@canadianweddingphotographers.com within 30 days of the overcharge.

14. Termination of Accounts for Violation of Code of Conduct

As a user of Canadian Wedding Photographers ("the Site"), you agree to abide by the following code of conduct. You agree to use our Site legally and not for illegal purposes. Specifically, you agree not to:

  • Harass or mistreat other users of our Site;
  • Violate the rights of other users of our Site;
  • Violate the intellectual property rights of the Site owners or any third party to the Site;

  • Act in any way that could be considered fraudulent; or

16. Arbitration Clause

Any dispute arising out of or in connection with this agreement, including any questions regarding its existence, validity, or termination, shall be resolved by arbitration in accordance with the laws of Manitoba, Canada. The arbitration shall be conducted by a single arbitrator appointed by mutual agreement of the parties or, in the absence of an agreement, by a neutral third party appointed in accordance with the laws of Manitoba.

The arbitration proceedings shall take place in Manitoba, Canada, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding upon both parties, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Each party shall bear its own costs, including legal fees, associated with the arbitration proceedings unless the arbitrator determines otherwise.

17. Governing Law for Arbitration Clause

The arbitration proceedings and the enforceability of this arbitration clause shall be governed by and construed in accordance with the laws of Manitoba, Canada.

Including an arbitration clause can be beneficial in streamlining dispute resolution processes. However, it's crucial to consult with a legal professional to ensure that the language used aligns with the specific legal requirements in your jurisdiction and serves your business interests appropriately.
